This Website is owned and operated by Jay’s Cakes a company registered in Abu Dhabi, UAE with its registered office at Abu Dhabi, UAE (“We” or “Us” as the case may be).  For the purposes of these Terms & Conditions, the terms “We” and “Us” refer to Jay’s Cakes.  When you purchase Products from our Website, you will be entering into a contract.

These Terms & Conditions apply to your use of the Website. By accessing, browsing, using or registering on our Website, you confirm that you have read, understood and agree to these Terms & Conditions in their entirety. Please check this page regularly to determine whether our Terms & Conditions have been updated – any new terms will automatically be effective when they are published on this Website.

We reserve the right to:

• amend our Terms & Conditions;
• refuse any user access to our Website;
• terminate user accounts;
• modify or withdraw (temporarily or permanently) this Website without notice; or
• cancel customer orders at our discretion.

Registration

You may register as a customer of the Website and as part of the registration process you will need to select a password which is in accordance with our password policy. You are solely responsible for the security of your password and account. You agree to notify us immediately if you suspect any unauthorised use of your account or access to your password. We will be storing your information to be able to make your experience with our brand better. Upon registration on our website, you will also be joining our loyalty program with the same account.

Intellectual property

All copyright, trademarks and other intellectual property rights in all material, content or software supplied as part of our Website, including emails or any other form of communication with you is protected by international copyright and database right laws and shall remain at all times vested in Us or where relevant.
You are permitted to use this material only as expressly authorised by Us. You may not extract and/or utilise the whole or any part of the Website without our express written consent.

We may provide the functionality to allow customers to provide Product ratings and reviews (“User Content”) in relation to the Products. If so, customers are solely responsible for such User Content, and you warrant that any User Content you post is accurate and that you are the sole author. We do not necessarily review User Content prior to it being posted and it may not reflect our views or opinions. You hereby assign to us all intellectual property rights in any User Content you post on the Website. We make no warranty as to the accuracy or reliability of such User Content. We reserve the right to remove User Content which in our sole opinion is deemed to be incorrect, offensive, illegal or otherwise unacceptable. User Content which provides negative reviews of Products will generally be deemed acceptable when objective, not otherwise in breach of these Terms & Conditions and posted by a verified customer.
The brand names and logos indicated on our Website and all related emails are owned by Us.

Limitation of liability

While we will use reasonable endeavours to verify the accuracy of any information we place on our Website, we make no warranties, whether express or implied in relation to its accuracy or in relation to any transaction that may be conducted on or through the Website, in our stores or with customer services (including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade).

Although our Website follows high levels of Information Security Standards, we make no warranty that our Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy or reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.
To the fullest extent permissible under applicable law, We disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with these Terms & Conditions for:
any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or any loss of goodwill or reputation; or any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these Terms & Conditions.
Nothing in these Terms & Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

General Entire Agreement

These Terms & Conditions set out the entire agreement between you and Us and supersede any and all prior terms, conditions, warranties and/or representations to the fullest extent permitted by law.

Law

Any matter that arises out of your use of our Website shall be governed by the applicable laws in the territory in which you are registered to use our Website and shall be subject to the exclusive jurisdiction of the courts of that relevant territory.

Waiver

If you breach these Terms & Conditions and we take no immediate action, this does not mean that We will not be entitled to assert our rights and remedies later.

Survival

Each provision of these Terms & Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Cancellation & Refund

Cancellation

If you wish to cancel your order, you may do so by contacting us on WhatsApp during working hours and within 24 hours before the delivery date.

• If you paid by credit card or debit card and you have cancelled in accordance with this clause then we will reverse the authorization or process a refund transaction as soon as possible. We are not responsible for how long this refund transaction will take to be reflected on your account as this is dependent on bank processing procedures.
• Big orders (defined as orders exceeding a certain value or quantity) must be cancelled at least one week before the delivery date.

Please note that we cannot accept cancellations outside of the specified periods as the order will have been processed and can only then be cancelled through our returns/refunds process as mentioned above.

Return & Exchange Policy

Full refund will be provided only if the cake hasn’t been manufactured yet.
Refunds will be processed within 7 to 14 days from the cancellation date.

Replacement Policy:

One free change is available for any design or color change, or for any mistakes made by us. Additional changes beyond the first free change will incur extra charges.
Any extra requirements or changes requested by the customer will be subject to additional charges.

Replacement cakes or items are only available for the same size and price. If the replacement is for a larger size or higher price, the price difference must be paid.
If there are any mistakes from our side, and it can be proven genuine, one free design change, flavor change, or model change within the same price range and weight will be provided.

Refunds: Subject to the above inclusions, we will process a refund upon receipt of the returned faulty, damaged or incorrectly supplied goods.

Shipping/Delivery Policy

For Dubai and Abu Dhabi:

A delivery charge of AED 30 will be applied for all orders below AED 500. Orders of AED 500 and above will receive free shipping. Orders received before 5pm will be processed and shipped on the same business day with estimated delivery between a minimum 5-6hours. Orders received after 5pm will be processed the next business day with delivery time starting at 2pm as the earliest or based on customer preference.

For other Emirates and Al Ain delivery:

A delivery charge of AED 50 will be applied for all orders below AED 500. Orders of AED 500 and above will receive free shipping. Orders received before 5pm will be processed and shipped on the next business day with estimated delivery between the timeframe of 2pm-10pm. Kindly note that we cannot give an exact time for delivery as it will be delivered depending on the route. We cannot do same day order for such areas as well. Feel free to reach out on our WhatsApp account for further assistance if you require a specific time, We can offer a special delivery with additional cost.

Please Note: 

Drivers will wait a maximum of 10 to 15 minutes for customers to collect their orders due to shop rush.

Product Policy:

Cake and flower colors may slightly differ from what is displayed on our website or Instagram due to photography and lighting effects.

We prioritize maintaining the taste, quality, and overall product integrity.
Availability of certain flowers may be seasonal. Customers are advised to check availability before placing an order.

Customers will be informed in advance of any availability issues or contingencies.
We recommend choosing lighter shades for cakes as darker shades may leave stains and may not be suitable for children.

Please note that by placing an order with us, you agree to abide by these terms and conditions. We reserve the right to update or modify these terms and conditions at any time without prior notice.
